Welcome to Fivonine. These Terms of Use ("Terms") govern your access to and use of Fivonine, including our website, platform, features, and services (collectively, the "Platform").
Fivonine is a platform that helps people discover Haitian creative talent, share creative work, connect with others, and discover opportunities.
By accessing or using Fivonine, creating an account, submitting content, or using any feature of the Platform, you agree to these Terms. If you do not agree, please do not use Fivonine.
1. Using Fivonine
You may use Fivonine only in compliance with these Terms and applicable laws.
You agree to provide accurate information when required and to use the Platform for lawful purposes.
You may not use Fivonine to:
Violate any law or regulation;
Impersonate another person or organization;
Provide false or intentionally misleading information;
Harass, threaten, or abuse another person;
Infringe another person's intellectual property or other rights;
Upload malicious software or harmful code;
Attempt to gain unauthorized access to the Platform or another user's account;
Spam, scam, or defraud other users;
Scrape or collect information from the Platform through unauthorized automated methods;
Interfere with the operation or security of Fivonine;
Circumvent restrictions or security measures;
Use the Platform for any purpose that violates these Terms.
Fivonine may restrict or terminate access if we reasonably believe an account or activity violates these Terms or creates a risk to the Platform or its users.
2. Accounts
Some features may require an account.
You are responsible for providing accurate information and keeping your account information up to date.
You are also responsible for maintaining the security of your account and should not share your password or account credentials with others.
You must notify Fivonine if you believe your account has been accessed without your permission.
You may not create an account using someone else's identity or information without authorization.
Fivonine may review, suspend, or remove accounts that contain false information, violate these Terms, or are otherwise harmful to the Platform or its users.
3. User Content
Fivonine allows users to submit and publish content, including creative work, images, videos, writing, project information, profile information, and opportunity listings ("User Content").
You retain ownership of the User Content you own.
By submitting User Content to Fivonine, you confirm that:
You own the content or have permission to use and submit it;
You have the necessary rights to allow Fivonine to display the content;
Your content does not knowingly infringe another person's rights;
Your content does not violate applicable law or these Terms.
You are responsible for the User Content you submit.
Fivonine does not claim ownership of your original creative work simply because you upload it to the Platform.
4. Permission to Display Your Content
When you submit User Content, you give Fivonine a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, format, distribute, and promote that content as reasonably necessary to operate and promote Fivonine.
For example, your work may appear:
On your Fivonine profile;
In search results;
In the Feed;
In relevant categories;
In other areas of the Platform;
In Fivonine promotional materials or official social media.
This license does not transfer ownership of your work to Fivonine.
You may remove your content where the applicable Platform feature allows you to do so. Some copies may remain temporarily in backups, technical systems, or materials already created before removal.
5. Content Review and Moderation
Fivonine may review content submitted to the Platform before or after publication.
We may approve, reject, edit for formatting, limit visibility, or remove content when we believe it is necessary to:
Enforce these Terms;
Protect users;
Protect the Platform;
Comply with applicable law;
Address intellectual property concerns;
Prevent fraud or abuse;
Maintain the quality and integrity of Fivonine.
Fivonine does not guarantee that every piece of User Content is accurate, complete, or independently verified.
Approval or publication of content does not mean that Fivonine endorses or guarantees it.
6. Intellectual Property
Fivonine and its original materials, including its name, logo, branding, website design, text, graphics, software, and other Platform materials, are owned by or licensed to Fivonine and are protected by applicable intellectual property laws.
You may use the Platform for its intended purpose, but you may not copy, reproduce, modify, distribute, sell, or commercially exploit Fivonine's intellectual property without permission.
Nothing in these Terms gives you ownership of Fivonine's intellectual property.
7. Copyright and Other Rights
Fivonine respects the intellectual property rights of others.
If you believe that content on Fivonine infringes your copyright or other intellectual property rights, please contact us at info@fivonine.com with sufficient information for us to review the matter.
Fivonine may remove or restrict content that it reasonably believes may infringe another person's rights.
We may also take appropriate action against accounts that repeatedly submit infringing content.
8. Directory
Fivonine may provide a Directory where users can discover creatives, professionals, organizations, and other participants.
Information in the Directory may be provided by users and may not be independently verified by Fivonine.
You are responsible for evaluating information and conducting your own due diligence before hiring, working with, or doing business with another user.
A Directory listing does not constitute an endorsement, certification, or guarantee by Fivonine.
9. Opportunities and Listings
Fivonine may allow users and organizations to share jobs, events, grants, collaborations, open calls, projects, and other opportunities.
Fivonine provides these listings primarily as a discovery and connection service.
We do not guarantee that:
A listing is accurate or current;
An opportunity is still available;
A listing provider is legitimate;
An applicant will be selected;
Payment will be made;
An event or project will take place.
Users should independently verify opportunities before providing personal information, paying money, signing agreements, or entering into professional relationships.
People or organizations submitting listings are responsible for the accuracy and legality of their listings.
10. Interactions Between Users
Fivonine helps users discover and connect with one another. However, Fivonine is generally not a party to agreements or transactions between users.
If you hire, collaborate with, sell to, purchase from, or otherwise work with another user, you are responsible for that relationship.
Fivonine is not responsible for disputes between users, including disputes involving payment, contracts, deadlines, services, creative work, or professional relationships.
11. Third-Party Links
Fivonine may contain links to third-party websites, services, or social media accounts.
These third parties operate independently from Fivonine.
Fivonine is not responsible for the content, availability, security, privacy practices, or terms of third-party websites or services.
Your use of a third-party service is subject to that service's own terms and policies.
12. Privacy
Your use of Fivonine is also governed by our Privacy Policy.
The Privacy Policy explains how Fivonine collects, uses, stores, and handles information associated with your use of the Platform.
By using Fivonine, you acknowledge that you have reviewed the Privacy Policy.
13. Communications
Fivonine may send you communications related to your account, submissions, opportunities, Platform activity, security, important updates, and other services.
Where required by law, you may opt out of promotional communications.
You may still receive essential communications necessary to operate your account or provide the Platform.
14. Platform Availability
We work to keep Fivonine available and functioning properly, but we do not guarantee that the Platform will always be available, uninterrupted, secure, or error-free.
Fivonine may temporarily suspend access for maintenance, updates, security issues, technical problems, or other reasons.
We may also change, add, or remove features as Fivonine develops.
15. Disclaimer
Fivonine is provided on an "as is" and "as available" basis to the fullest extent permitted by law.
Fivonine does not guarantee the accuracy, completeness, reliability, availability, or suitability of information or content provided through the Platform.
Fivonine does not guarantee any particular result from using the Platform, including employment, clients, funding, collaborations, sales, exposure, or other opportunities.
Nothing in these Terms excludes any rights or protections that cannot legally be excluded.
16. Limitation of Liability
To the fullest extent permitted by law, Fivonine and its owners, operators, employees, contractors, and service providers will not be responsible for indirect, incidental, special, consequential, or punitive losses arising from your use of or inability to use the Platform.
This includes losses resulting from interactions or transactions between users, third-party services, User Content, interruptions to the Platform, or reliance on information available through Fivonine.
Nothing in these Terms limits liability that cannot legally be limited or excluded.
17. Indemnification
To the extent permitted by law, you agree to defend and hold harmless Fivonine and its owners, operators, employees, contractors, and service providers from claims, losses, liabilities, costs, and expenses arising from:
Your violation of these Terms;
Your violation of applicable law;
Your User Content;
Your infringement of another person's rights; or
Your misuse of the Platform.
18. Suspension and Termination
You may stop using Fivonine at any time.
Fivonine may suspend or terminate your account or restrict your access to the Platform if we reasonably believe that:
You have violated these Terms;
You have violated applicable law;
Your account contains fraudulent or misleading information;
Your activity threatens the security or integrity of the Platform;
Your activity creates a risk to other users or Fivonine; or
We are required to do so for legal or regulatory reasons.
Where appropriate, Fivonine may provide notice before restricting or terminating an account.
Some provisions of these Terms will continue to apply after termination where their nature requires them to continue.
19. Changes to These Terms
Fivonine may update these Terms as the Platform develops or as our services, practices, or legal requirements change.
When we make changes, we will update the "Last Updated" date at the top of this page.
Where required by law, we will provide additional notice of significant changes.
Your continued use of Fivonine after updated Terms take effect means that you accept the updated Terms.
If you do not agree with the updated Terms, you should stop using the Platform.
20. Changes to the Platform
Fivonine is continually developing.
We may introduce new features, modify existing features, change how content is displayed, or discontinue features.
We may also introduce additional services or features that are governed by additional terms when appropriate.
21. Governing Law
These Terms are governed by applicable law, except where applicable law provides otherwise.
Nothing in these Terms prevents you from exercising rights that cannot legally be waived or restricted.
22. Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or removed to the extent necessary, and the remaining provisions will continue to apply.
23. Entire Agreement
These Terms, together with Fivonine's Privacy Policy and any other policies expressly incorporated into these Terms, constitute the agreement between you and Fivonine regarding your use of the Platform.
